General Terms and Conditions Web Shop
These General Terms and Conditions for the web shop (hereinafter referred to as "GTC") apply to all purchases conducted by the Customer via the web shop of [ELONGATE.CC] ("Provider").
Offer and conclusion of contract
The products and prices in the web store are considered as an offer. However, this offer is always subject to the contract dissolving condition of an impossibility of delivery or an incorrect price indication.
The purchase contract is concluded as soon as the order placed by the Customer in the web shop is confirmed by the Provider by email (order confirmation = acceptance).
The Client may cancel from the order until it has been processed by contacting Provider by e-mail to the following address: [firstname.lastname@example.org]
The web shop may be used only by persons who are at least 18 years old. Anyone under 18 may use the web shop only with the consent of their parents or legal guardians.
In order to be able to order in the web store, the Customer must register in advance with his full name and email address. The Customer assures that all data provided during registration are true and complete. The Customer agrees that all activities carried out with his access data (especially placed orders) will be attributed to him. Provider disclaims any liability for consequences of improper handling of access identification data on the part of the Customer.
Products and prices
The web shop includes information about the features of the products, their prices and further specifications. Provider tries to get product specifications right, but they may differ from the product. Images of products in the web shop are for illustrative purposes and are not binding.
Provider reserves the right to withdraw or substitute products if necessary. Products are subject to availability while stocks last. If a product is out of stock or the order cannot be processed for any other reason, the Customer will be notified via email.
The price specified in the web shop at the moment of placing the order is the final price, binding both upon the Customer and Provider. Once the order is placed, the price will not change, notwithstanding any price adjustments made by Provider and regardless of any special offers or sales.
The indicated product prices do not include the value added tax and shipping cost. The value added tax and shipping costs will be charged in addition to the purchase price.
Payments and late payments
Various payment options are available to the Customer in the web shop. Provider reserves the right to suspend individual payment options temporarily or permanently. The Customer has no right to pay via the payment method chosen by him.
If the Customer fails to meet its payment obligations in whole or in part, all outstanding amounts owed by the Customer to Provider under any title shall become due immediately (in the case of advance payment within 8 calendar days of the 1st reminder) and Provider may immediately demand payment thereof and discontinue further deliveries of products to the Customer.
ELONGATE Merch isn't available in some countries because of legal restrictions or shipping carrier limitations.

Provider endeavours to indicate delivery times in the web shop accurately. However, due to production or delivery bottlenecks, but also for other reasons, there may be delays in delivery. All information on delivery time is therefore without guarantee and may change at any time.
The Customer has the right to rescind the sales contract within 14 days without cause. The right of rescission expires 14 days of the day on which the Customer came into possession of the products or a third party specified by the Customer.
Any claims for misprinted/damaged/defective items must be submitted within 14 days after the product has been received. For packages lost in transit, all claims must be submitted no later than 4 weeks after the estimated delivery date. Claims deemed an error on our part are covered at our expense.

Write up your problem in detail and upload relevant photos where possible
Be aware that we may require a photo to be submitted with your problem report to begin a reshipment. It is always best to include photos with your initial problem report to avoid delays.
Wrong Address - If you provide an address that is considered insufficient by the courier, the shipment will be returned to our facility. You will be liable for reshipment costs once we have confirmed an updated address with you (if and as applicable).
Unclaimed - Shipments that go unclaimed are returned to our facility and you will be liable for the cost of a reshipment to yourself (if and as applicable).
ElonGate does not accept returns of sealed goods, such as but not limited to face masks, which are not suitable for return due to health or hygiene reasons.
Notification for EU consumers: According to Article 16(c) and (e) of the Directive 2011/83/EU of the European Parliament and of the Council of 25 October 2011 on consumer rights, the right of withdrawal may not be provided for:
- the supply of goods that are made to the consumer's specifications or are clearly personalised;
- sealed goods which were unsealed after delivery and thus aren't suitable for return due to health protection or hygiene reasons
Therefore the Provider reserves rights to refuse returns at its sole discretion.
This Policy shall be governed and interpreted in accordance with the English language, regardless of any translations made for any purpose whatsoever.
In the event of sales contract rescission, Provider refunds all the received payments to the Customer, including the costs of delivering a product without undue delay.
The refund shall be made using the same payment channel as was used by the Customer in the original transaction, unless the Customer has explicitly agreed to another solution. In any case, the Customer will bear no charges connected with that refund.
Provider may withhold the refund until it receives the product back or until the Customer provides a proof of sending the product back, whichever takes place first.
Any product bought in the web shop of Provider can be complained about under the applicable statutory warranty provisions of the British Civil Code if a defect was found in the product within two (2) years of its acquisition by the Customer, where the defect makes the product inconsistent with the contract.
A complaint can be filed by e-mail to the following address: [firstname.lastname@example.org] and must specify the causes of the complaint and the information required to identify the order.
Provider makes it possible for the Customers who file a complaint to send back defective products by post at Provider’s cost. Provider shall examine the complaint and shall inform the Customer about the outcome.
If the outcome of the complaint is positive, the Customer will be reimbursed for any reasonable costs of shipping the defective products to the web shop.
If the outcome of the complaint is negative, the goods will be shipped back to the Customer with a notice explaining that the complaint was deemed unfounded.
It should be noted that a new warranty is not granted after the warranty service has been rendered.
Applicable law and jurisdiction
Please note that these GTC are governed by English law. If the Customer is a consumer, this means a contract for the purchase of products and any dispute or claim arising out of or in connection with it will be governed by English law, except that if the Customer is not resident in England then English law shall apply only to the extent that it does not override any mandatory laws of the country in which the Customer has his usual place of residence.
In respect of any dispute or claim relating to a contract, if the Customer is a consumer, then both Consumer and Provider submit to the non-exclusive jurisdiction of the courts of England and Wales, but nothing in this clause shall limit Customer’s legal rights to bring actions against Provider or to require proceedings to take place in the country in which the Customer has his usual place of residence. If the Customer is not a consumer, both the Customer and Provider submit to the exclusive jurisdiction of the courts of England and Wales.
If any provision of these GTC is or becomes invalid in whole or in part, this shall not affect the validity of the remaining provisions of these GTC. Instead of the invalid provision, the legally permissible provision that comes closest in economic terms to the meaning and purpose expressed in the invalid provision shall apply. The same shall apply in the event of a loophole in these GTC.
These GTC may be changed by the Provider at any time without prior notice and without giving reasons.
